1. General Provisions

• Eligibility: The Platform is available only to UAE residents aged 18 years or older who have the legal capacity to enter into binding agreements. Account acceptance is subject to verification of identification details.
• Scope: These Terms apply to all services available on the Platform, including purchasing, gifting, and selling gold and silver products.
• Updates to Terms: Ain Gold reserves the right to update or modify these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.

2. Use of the Platform

• Account Creation: An account is required to make purchases or gift products. Users must provide accurate information and maintain the confidentiality of account credentials.
• Prohibited Activities: Users shall not engage in unlawful activities, unauthorized access, misrepresentation, or actions that disrupt Platform functionality.
• Platform Availability: Access to the Platform may be suspended temporarily for maintenance, upgrades, or technical reasons without prior notice.

3. Purchasing and Gifting Gold and Silver

• Product Purchases: Prices are displayed in AED and confirmed at checkout. Prices are subject to availability and market fluctuations.
• Transparency and No Hidden Fees: All applicable fees are disclosed upfront. Ain Gold does not charge any hidden fees.
• Gifting Features: Users are responsible for ensuring the accuracy of recipient information when gifting products.
• Payment: Payments must be made using secure payment methods with accurate billing information.
• Order Confirmation and Cancellation: Orders may be cancelled before processing. Once processed, orders may only be returned in accordance with the return policy.

4. Quality and Security

• Product Quality: All products are certified in accordance with GIA standards and described accurately to the best of our knowledge.
• Security: Advanced encryption and security measures are used to protect user data. Users are responsible for maintaining reasonable security practices.

5. Returns and Refunds

• Return Policy: Products may be returned within 3 days of delivery if unused and in original condition. Certain items may be excluded.
• Refunds: Approved refunds are processed within 7 business days to the original payment method. Delivery charges are non-refundable unless the error is attributable to Ain Gold.
• Defective Products: Any defective or damaged product must be reported within 3 days of delivery for replacement or refund at no additional cost.

6. Shipping and Delivery

• Delivery: Shipping is available within the UAE. Estimated delivery time and costs are displayed at checkout.
• Risk of Loss: Ownership and risk of loss transfer to the customer upon delivery.

7. Intellectual Property

• Ownership: All content on the Platform is the intellectual property of Ain Gold or its licensors.
• Limited License: Users are granted a limited, personal, non-commercial license. Any reproduction or redistribution requires prior written consent.

8. Limitation of Liability

• Disclaimer: The Platform and products are provided “as is” without warranties of any kind, express or implied.
• Liability Cap: Ain Gold’s total liability shall not exceed the amount paid by the user for the relevant transaction.
• Market Fluctuations: Ain Gold is not responsible for financial losses arising from fluctuations in gold or silver prices.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall first be resolved through amicable negotiation. Unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Dubai.

10. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy.

11. Termination

Ain Gold reserves the right to suspend or terminate access to the Platform for any violation of these Terms or for conduct deemed harmful to the Platform or its users.

• Products are sourced and traded in accordance with UAE Central Bank guidelines, DMCC regulations, and other regulatory authorities.
• Consumer rights are protected under UAE Consumer Protection Law, ensuring transparency, fair pricing, and accurate product descriptions.
• KYC verification is mandatory before purchasing or gifting products.
• All products are ethically sourced and conflict-free, with full compliance to UAE VAT rules.
